DMCA COPYRIGHT POLICY

PROFCARE LLC ("Apiroi", "we", "us", "our") respects the intellectual property rights of others and expects users of our Service to do the same.

This Digital Millennium Copyright Act ("DMCA") Policy explains how to submit a copyright infringement notice (takedown request) and how we handle counter-notices.


1. COPYRIGHT INFRINGEMENT NOTIFICATION (DMCA TAKEDOWN)

If you believe that content available on apiroi.com or within the Apiroi mobile application infringes your copyright, you may submit a written notice to our designated DMCA Agent.

1.1 Required Information (17 U.S.C. §512(c)(3))

B. Identification of Copyrighted Work

  • Identification of the copyrighted work claimed to have been infringed

  • Identification of the material claimed to be infringing or to be the subject of infringing activity
  • Information reasonably sufficient to permit us to locate the material, such as:
    • URL(s) where the material appears
    • Screenshots or descriptions
    • User profile or listing ID (if applicable)

D. Contact Information

  • Your name (full legal name)
  • Mailing address
  • Telephone number
  • Email address

E. Good Faith Statement

  • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law

F. Accuracy and Authority Statement

  • A statement that the information in the notification is accurate
  • A statement, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

1.2 How to Submit a DMCA Takedown Notice

1.3 Processing Takedown Requests

Upon receiving a valid DMCA notice, we will:

  • Promptly investigate the claim
  • Remove or disable access to the allegedly infringing material (if appropriate)
  • Notify the user who posted the content (if identifiable)
  • Document the complaint

  1. COUNTER-NOTICE PROCEDURE (DMCA Counter-Notification)

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notice.

2.1 Required Information (17 U.S.C. §512(g))

Your counter-notice must include:

A. Signature

  • Your physical or electronic signature

B. Identification of Removed Material

  • Identification of the material that was removed or to which access was disabled
  • The location where the material appeared before it was removed or disabled (URL, listing ID, etc.)

C. Good Faith Statement

  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification

D. Contact Information

  • Your name (full legal name)
  • Address
  • Telephone number
  • Email address

E. Consent to Jurisdiction

  • A statement that you consent to the jurisdiction of:
    • The Federal District Court for the judicial district in which your address is located (if in the United States), OR
    • The Southern District of New York (if outside the United States)
  • A statement that you will accept service of process from the person who submitted the original DMCA notice (or their agent)

2.2 How to Submit a Counter-Notice

2.3 Processing Counter-Notices

Upon receiving a valid counter-notice, we will:

  • Forward the counter-notice to the original complainant
  • Inform the complainant that we may restore the removed material in 10-14 business days
  • Restore the material (unless the complainant files a court action seeking a restraining order) after 10-14 business days

3. REPEAT INFRINGER POLICY

3.1 Termination of Repeat Infringers In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers.

3.2 What Constitutes a Repeat Infringer We may consider a user a repeat infringer if:

  • They have been the subject of multiple valid DMCA takedown notices
  • They repeatedly post infringing content after receiving warnings
  • They demonstrate a pattern of copyright infringement

3.3 Account Termination Repeat infringers may have their accounts suspended or permanently terminated at our discretion.


4. MISREPRESENTATION

4.1 False Claims Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents:

  • That material or activity is infringing, OR
  • That material or activity was removed or disabled by mistake or misidentification

may be liable for damages, including costs and attorneys' fees.

4.2 Good Faith Requirement Please ensure your DMCA notice or counter-notice is submitted in good faith and contains accurate information. False or bad-faith claims may result in legal liability.


5. LIMITATIONS AND DISCLAIMERS

5.1 No Legal Advice This policy provides general information about the DMCA process. It does not constitute legal advice. If you have questions about your rights or obligations under copyright law, please consult with an attorney.

5.2 Third-Party Content We are not responsible for user-generated content posted on the Service. Copyright disputes are between the copyright owner and the user who posted the content.

5.3 Discretion We reserve the right to remove content or terminate accounts at our discretion, even in the absence of a formal DMCA notice, if we believe content violates our Terms of Service or applicable law.
